How to Start Your Law Firm – Part 5 – Your Business Plan, Your Vision, Your Mantra
The Terpening Law Blog
by Will Terpening

You can even treat your law firm as a profit-making enterprise, if you want to! Like many lives, businesses, and cartoon pirate-ghost ships, some law firms listlessly float with no rudder, taking few risks, not reflecting on issues like why the firm exists (the assumption being that it exists simply to make money, silly!), and taking no risks. This is not the right approach. Just as your life needs a plan, your new and growing law firm needs a plan. And just as in life, if you chart a course to get somewhere meaningful, you’re well on your way to your dreams and lesser goals even if you fal ..read more

Step four in our ten step series of a federal criminal case explains what a criminal arraignment is in a federal criminal matter and what happens during an arraignment. There are slight differences between the procedure for arraignment in North Carolina state court and in federal court. This article discusses federal arraignments.  An arraignment is a court proceeding at which a criminal defendant is formally advised of the charges against him and is asked to enter a plea to the charges. At this time the court may also conduct what is called a “detention hearing” to decide whether the defen ..read more

An indictment follows the decision reached by the grand jury discussed in Step Two of this series. A formal indictment is simply another step in the procedure of the federal criminal justice process and does not bear any weight on whether you are guilty or innocent of a crime. The Indictment An Indictment is a written formal accusatory document against a person who is no longer merely being suspected of a crime. At this point the prosecution believes that there is sufficient evidence against a person to charge them with a felony. The right to be indicted is embodied in the 5thAmendme ..read more

A grand jury subpoena is often the second (or an early) step in the federal criminal justice process. A grand jury subpoena is a formal document that orders a named individual to appear before the Court at a certain time and date to give testimony (subpoena “ad testificandum”) and/or produce documents relevant to the investigation (subpoena “duces tecum”). Usually these individuals are either: (a) a witness to illegal activity; or (b) a suspect (target or subject) in an investigation.  Once you are served with a Subpoena… Please keep in mind that you cannot refuse a subpoena or just “blo ..read more

On Monday, June 17, The United States Supreme court held that criminal defendants may be prosecuted for the same offenses in both federal and state court, reaffirming its long-held view of the dual-sovereignty doctrine. In Gamble v. United States, Petitioner Terance Gamble was convicted under an Alabama statute for possessing a firearm as a felon. U.S. No. 17-646 (June 17, 2019). Soon after, the government indicted him on the same charges under a federal possession of a firearm statute. The Supreme Court held that the charges did not qualify for double jeopardy protections because of the du ..read more

Many people are unaware that they are being investigated until after they’ve already participated in their own investigation. Sometimes, the government may send you a letter in the mail letting you know that you’re being investigated. However, the government can and will take a more dramatic approach by doing the following:  1. Call ..read more
