Recording Remote Court Hearings As with a lot of things, the manner in which court hearings are conducted has changed vastly over the past 12 months or so. As family solicitors we are now well adapted to the concept of ‘remote hearings’ and the wonders of technology which enables people from all over the world to connect into the same virtual family court hearing – something which, previously, was only an option in very specific circumstances. Although the concept of attending a court hearing live from your kitchen might seem somewhat informal, ultimately, this is still a court hearing and the ..read more

Top 10 tips to help navigate child law disputes   It can be difficult enough for parents who are in a relationship to reach agreement on all of the decisions that relate to their children.  When parents are separated or divorced this can add a further layer of complexity and emotion, both immediately following separation and as the needs of the child change over time.  Child arrangements can be tricky. Court proceedings can be distressing (not only for the parents but also the child involved) and expensive and should usually only be considered where all other routes for r ..read more

The Focus on Coercive and Controlling Behaviour   As the nation is experiencing a third national lockdown, there remains a focus on domestic abuse both in the wider community and within recent case law.   BBC news reported last week that calls to domestic abuse services have sadly continued to surge as couples spend more time at home during the pandemic.  The article was an attempt to reach out to employers generally, to keep an eye out for signs of their employees suffering from or being at risk of domestic abuse.   If somebody is suffering as a result of an abusive partne ..read more

What is the impact of Brexit on Divorce?   Forum shopping after Brexit- Can I get a divorce in England and Wales?   With the news focused heavily on Covid-19, lockdowns, vaccinations, new strains and so on Brexit has somewhat taken a back seat.  However, the legal implications are far reaching.   Within the family law arena, for example, leaving the EU means that ex-pats living in other EU countries are more likely to be able to obtain an English divorce.   For example, if you were previously an English wife living in Spain with your Spanish husband you would very like ..read more

The Differences and Similarities of the Divorce Process – England & Wales vs. New Zealand   As I approach four years of living in the United Kingdom after relocating from New Zealand in March 2017, I thought I would share some of my observations on the differences and similarities between family law in both countries. Having now practiced under both jurisdictions, and being dual-qualified, there are a number of things which I believe both systems have which the other could easily benefit from.   Difference 1: In New Zealand divorce is no one’s fault, and you don’t need a solicito ..read more

Parental Disagreements: Will the Court Order my Child to be Vaccinated Against COVID-19?   Last August I wrote about what the likely outcome would be should parents be in dispute about whether or not a child should be vaccinated against COVID-19. A link to that article can be found here. To quickly summarise the general position when it comes to the vaccination of children; where parents are unable to agree whether a child should be vaccinated, they will need to seek the direction of the Family Court who will ultimately decide the outcome based on what is in the child’s best intere ..read more

We obtained a Final Divorce Order in only 61 minutes!   Yesterday we set our own record in the firm for obtaining a decree absolute on behalf of a client which typically takes around 2 – 10 days to obtain. Using the online divorce system, we submitted our client’s application for decree absolute at 1:55pm and it was granted within 61 minutes. It might not satisfy the press, but it certainly pleased our client! This morning the media outlets are reporting that Kayne West and Kim Kardashian West are set to divorce. Celebrity divorces constantly make the front pages of our newspapers, and th ..read more
